工业产品生产许可证审查的法定依据

《中华人民共和国工业产品生产许可证管理条例》（国务院令第440号，2005年7月9日）第二条：“国家对生产下列重要工业产品的企业实行生产许可证制度：

（六）法律、行政法规要求依照本条例的规定实行生产许可证管理的其他产品。”。

国务院办公厅《关于印发国家质量技术监督局职能配置内设机构和人员编制规定的通知》（国办发[1998]84号）主要职责（三）：“管理工业产品生产许可证工作”。
