一、申请阶段

从事食品生产加工的企业（含个体经营者），应按规定程序获取生产许可证。新建和新转产的食品企业，应当及时向质量技术监督部门申请食品生产许可证。省级、市（地）级质量技监部门在接到企业申请材料后，在15个工作日内组成审查组，完成对申请书和资料等文件的审查。企业材料符合要求后，发给《食品生产许可证受理通知书》。

企业申报材料不符合要求的，企业从接到质量技术监督部门的通知起，在20个工作日内补正，逾期未补正的，视为撤回申请。

二、审查阶段

企业的书面材料合格后，按照食品生产许可证审查规则，在40个工作日内，企业要接受审查组对企业必备条件和出厂检验能力的现场审查。现场审查合格的企业，由审查组现场抽封样品。

审查依据及内容 以国家质检总局发布的食品生产许可审查细则为依据，对生产场所环境，工艺流程，设备布局，设备状态，仓储场所条件以及管理规程，人员配置等。

审查组或申请取证企业应当在10个工作日内（有特殊规定的除外），将样品送达指定的检验机构进行检验。发证检验 并按照具体的产品类别进行相应的项目检验，一般检验项目根据产品类别不同类别项目多少和检验费用均有不同。发证检验会侧重食品的安全性指标，对各种添加剂尤其是影响食品安全的各种常见的非食品添加物均会检验。
