（三）推动完善认证认可体系  参照国际通行规则，建立健全法律法规、行政监管、认可约束、行业自律、社会监督相结合的认证认可管理模式，完善认证认可体系。

贯彻落实：近年来，国家认监委在国家质检总局的统一领导下，积极履行职责，创新监管思路，初步建立了既符合国际规则，又具有中国特色的“五位一体”认证认可管理体制。按照《纲要》要求，进一步健全完善认证认可管理模式，需要着重做好以下工作：

第一，完善法律法规，进一步规范认证行为。目前，国家现行有效的涉及认证认可工作的法律18件，行政法规17件。以《认证认可条例》为核心，15件部门规章，29件规范性文件为配套的我国认证认可法规体系已经基本构建。在此基础上，应根据认证认可事业发展的需要，继续加强认证认可配套规章和行政性规范性文件的制修订工作。支持、配合相关部门在本部门立法中，引入认证认可手段，改革行政管理方式。继续深入开展立法后评估工作，及时发现问题，通过立法途径解决问题，促进认证认可事业的健康发展。

第二，引导与监督相结合，不断加强行政监管的力度。强化“统一管理、共同实施”机制，充分发挥部际联席会议的制度优势，推动强制性产品认证、管理体系认证、自愿性产品认证、服务认证等各项认证制度不断发展完善。以省级质量技术监督部门和直属出入境检验检疫机构为依托，构建省、市、县和口岸为一体的地方认证监督管理组织体系，下移监管重心，有效发挥地方认证监管部门区域管理作用。加大监督执法力度，采取专项监督检查、市场产品抽检、认可机构突查、投诉案件调查等多种方式，多管齐下进行监督检查，有效震慑认证违法违规行为，构建良好的认证市场和从业环境。

第三，加强技术保障，提高认可约束的有效性。坚持统一、权威的国家认可制度。大力发挥认可对认证从业机构技术能力的评价作用，为加强政府监管、提升认证有效性提供技术支撑服务。

第四，建立行约行规，搞好行业自律。积极发挥中国认证认可协会在政府、行业、获证组织与消费者之间的桥梁与纽带作用，在行规行约建设、认证人员管理、行业自律监管、技术标准制修订等方面发挥更大作用。第五，鼓励社会公众参与，加强社会监督力度。建立完善认证认可义务监督员制度，加强认证认可舆论监督制度化保障机制，以舆论监督引领认证认可行业健康发展。
