第十六条协会对在监督检查或调查中发现的认证机构价格违规行为，视情节轻重分别予以处理。

（一）协会在监督检查或调查中发现认证机构一年内出现价格违规项目数量或价格违规行为次数较少，涉及的组织规模较小，没有造成其他负面影响的，责令其立即纠正，并给予书面警告。

（三）协会在监督检查或调查中发现认证机构一年内频繁出现价格违规的项目或行为，并在行业内造成了较大的负面影响的，责令其立即纠正，给予公开通报批评，并处交纳违约金 5-10 万元。

（四）有下列情况之一者，将其违反公平竞争规范的事实给予公开通报，并处交纳违约金 10 万元。

（五）对拒绝交纳违约金的违规认证机构，在其公平竞争信誉保证金中扣除相应金额，并责成其补足公平竞争信誉保证金。

第十七条协会根据对认证机构执行价格自律情况监督检查的结果，还可以作出如下奖惩处理：

（一）协会对 D 级机构在协会网站上进行公示。

（二）对 A 级机构实施如下鼓励措施：

1．适当减少价格自律检查的抽查频次和抽样数量；

2．允许 A 级机构转换 D 级机构的证书，对其它机构的证书转换按协会有关的规定执行。

（三）对 D 级和 C 级机构实施如下全部或部分处罚：

第十八条协会对认证机构执行本规范的情况进行客观评价后，可启动认证认可联动工作机制，向国家认证认可行政监管部门和/或认可机构进行通报。对于所发现的问题，特别是 D 级机构的问题，利用联动机制深入核查。

第十九条认证机构若对协会的处理决定有异议，可于收到违规处理通知后 15 个工作日内，以书面形式向协会提出申诉。
